I thought this wasn't allowed. But for anyone interested, the course is listed here: Gary Bencivenga Marketers and Copywriters Master Course - eBay (item 190502626731 end time Feb-20-11 18:29:26 PST)

    From the sales letter...

    3. You must keep what you learn confidential. You must agree in writing never to publish, resell, or distribute the information you learn in The Bencivenga DVD Course in any way, shape, or form. This is because you will be learning copyrighted proprietary formulas and trade secrets that are for your own use and benefit but not for resale or redistribution in any way.
In fact, on the advice of Jay Abraham (a friend who's conducted many seminars himself) ... and some of the best legal minds who know how to protect intellectual property, you technically will not own any of the materials you receive. Your $5,000 entitles you to lease these materials indefinitely, provided you do not try to sell or distribute the information in any way. If you do, we will revoke your license and move to confiscate the illegally sold material from whomever purchased it from you.
This protects my intellectual property, and it also protects the investment you're making, as these materials will never be allowed to be sold more cheaply on eBay or any other source nor be widely available anywhere."

I know. That why I wrote, "I thought this wasn't allowed."

It hasn't stopped this guy putting it on eBay, though.

Come to think of it, there's loads of pirated copies of other top courses on eBay.

If I wasn't strict about buying legit stuff, I'd be getting all of them.

        Mate, I'm the same.

It's all in the mind. If you're the kind of person who only wants to steal all these courses then what does it say about your attitude to money?

What does it say about your ethics?

Lots of unethical people at the bottom but very few at the top...

I've seen his remarks before. I'm not sure it is enforceable. In any event, a buyer can happily TELL you the Bencivenga persuasion equation, 100% legally. You can't protect an idea.

If it was stated in the agreement... whether the sales letter and/or order form was signed or not... the product is most certainly protected.

If Gary wants to shut that auction down, he can. He just has to contact eBay's VERO:

      eBay: VeRO

There are some stipulations but in Gary's case, they are easily addressed.

You can most certainly get products taken off Ebay if selling them on ebay violates the terms of the agreement people buy under, or if you can prove it's a pirated copy (Ie you only sold digital version of the product, but this is a physical version being sold). I have my assistant look on ebay about once a week, and we typically get 3 to 5 products removed every month. Ebay is pretty easy to deal with in these types of situations.
