What can we say, what cant we say, whats a grey area?

For example I have a new product coming out soon, how can i legally word the ad? I obviously cannot "You WILL make a fortune from this", I assume I can say "You COULD make a fortune just by..." but a grey area may be "You can make a fortune just by..."

You can put whatever you want in an ad. The internet is like that.

Are you referring to adwords? They're not really involved with "legalities."

If you mean what can you get approved in an ad for adwords, your
whole idea of getting a get rich quick and making a fortune scheme is not
going to be approved anyway. No matter what the ad says.

Anything like "make a fortune" is against TOS of adwords. It makes an
    unrealistic claim.

'New product" ? You mean one more digital product piled on top of
the grave yard? Not gonna happen on adwords.

      No you can't. Not legally.

Talk to a lawyer if you're unsure, but a good rule of thumb is don't make claims you can't back up

There are very fine lines about what you can and cannot do.

I heard a Dan Kennedy talk about this once and mention that you can write a book telling people that shark cartilage prevents cancer because sharks don't get cancer. As a book that's protected speech.

But, if you make shark cartilage supplements and tell people they will not get cancer if they take your supplements you will get shut down and sued by the government. That's a fraudulent claim because you cannot back it up.

I probably just confused you more....

In a nutshell, if you didn't make a million dollars using your method you shouldn't claim that anyone else will...

Plus, I think the new FTC guidelines have something about AVERAGE USER RESULTS. What will the average user of your product get out of it?

That being said, if your new product is a WSO, the average WSO buyer never gets off the computer and takes action, so you might need to title it How to fill up 40MB on your hard drive for ONLY $17

      • It appears I didnt word the original post very well. I am developing a tool that will definitely help a business increase customer relations & others can use it as a business by itself - it is not a get rich scheme, but does have the potential to generate significant wealth if the user puts a little time & effort in!

My post was purely regarding the wording of an ad, whether it be Craigslist, Adwords, Facebook etc. Ads need to be tempting enough to be clicked on, but I cant write pure BS, im not into misleading anyone (but there's no point writing an ad thats not compelling enough to be clicked on!)
