Adbrite check not delivered and they are not willing to reissue a check

I had a payout in the month of November'11 from Adbrite for some $$$ amount. For some reason, I didn't login to my account all this while and found that they had sent me a check which was not delivered at my address in India.

I sent them a request yesterday to re-issue a check (and may be they can deduct some amount for re-issue) but they refused directing me their subscriber agreement adBrite Exchange

Do I have any options now? or my money in mid 3 digits is gone?

    First, I curse you for me having to read through the entire subscriber agreement (which I might add was single spaced and contained HUGE paragraphs) in order to try to find something that might apply to your situation.

    Their user agreement pretty much says that you have up to 180 days after payment was made to make a dispute with them or get your payment re-issued.

    However, according to you, "for some reason" you didn't log into your account for months and months and months. And guess what? It costs you money.

    When it comes to money, KEEP YOUR EYE ON THE BALL. It was callous that you weren't even aware of the fact that you were making money with Adbrite and you were not even aware you got a check.

    As cruel as it sounds, you just learned a very expensive lesson and I bet it won't be a mistake you'll make twice.

    According to this, you are screwed...

    Publisher acknowledges and agrees that checks payable to Publisher that are not cashed within 180 days from the date of issuance will be cancelled by Company and will not be reissued, and in the event of such cancellation, Publisher irrevocably waives any right to payment of amounts represented by such checks.
    A reputable company, however, would re-issue the check with no hesitation.

      Yeah I understand it was partially my fault, I should have followed it up with them within 180 days but I was wondering if any of our WF friends here got into such a situation before?

      Exactly! I understand that is written in a subscriber agreement but still that money was mine and I couldn't get it because of inadvertent issues of postal deptt and I not able to follow up within stipulated time frame.

    I hate adbrite anyway. They treat their publishers like crap and have terrible payouts.

    I recently logged into my adbrite account to find there was still a balance of an $xxx amount owing to me from a while back.

    I contacted them about it and they said the same thing, basically stating they can't reissue the payment for the reasons mentioned above.

    Not only did I never recieve this payment, it doesn't even show the money as being processed on my account. Also I had set a very high payment threshold due to personally circumstances and not wanting to receive a cheque at the time.

    That really sucks.. sorry but I don't think you can do anything about it - Adbrite laid out out in the TOS which no one reads.

    If you have some money in an account somewhere, it's best to check it frequently, especially if you feel something might have gone wrong.
