You do. They are selling their effort to review your website, [read: which does not automatically guarantee an inclusion, even though they do offer money back in case of disapproval].

So in terms of policies there is no violation, even you do pay your money.

I have always heard to just do the free ones but, I don't think paid ones would be penalized

I bough couple of paid ones and I never been penalized for that (Though I've been eventually penalized for some other things...)
In fact the featured listings gave me an instant boost in SERP (within 2-3 weeks) and a solid PR (after update).

Hi sarged2 thanks for the input! I was thinking more of it from the directories point of view. Do you think they are getting punished from Google? Or is the directory model exempted from the "selling links" ban?

If directory related google will not ban you and if you boost your site by thousands of directory and irrelevant then Google must punish you. And if it is health related blog or website then Google 100% punish your website.

Google always observing the backlinks for a website by Google's algorithm. Finally I want to say @sarged2 you are a lucky man!
